第四條借款人保證按期償還全部貸款本息。貸款逾期部分,貸款人有權(quán)在一定期限內(nèi)收回貸款。如有必要,貸款人可從借款人賬戶中扣除。如果貸款單位于另一家銀行且有存款賬戶,貸款人可以與銀行協(xié)商,要求銀行扣除結(jié)算款
第五條借款人愿意按照銀行抵押貸款的規(guī)定,以自有財(cái)產(chǎn)或貸款新增的固定資產(chǎn)作為抵押,抵押品隨附詳細(xì)清單,作為本合同附件。借款人不履行合同時(shí),貸款人有權(quán)處分抵押物和優(yōu)先受償權(quán)
請(qǐng)借款人作為貸款的擔(dān)保人,經(jīng)貸款人核實(shí)擔(dān)保人有足夠的補(bǔ)償性財(cái)產(chǎn)。擔(dān)保人有權(quán)檢查并督促借款人履行合同。借款人不履行合同的,保證人應(yīng)當(dāng)承擔(dān)連帶償還本息的責(zé)任。第六條貸款人有權(quán)對(duì)貸款的使用情況進(jìn)行檢查和監(jiān)督,了解借款人的經(jīng)營(yíng)管理、計(jì)劃執(zhí)行、財(cái)務(wù)活動(dòng)、物資庫(kù)存等情況,借款人應(yīng)當(dāng)提供工作便利。借款人必須按時(shí)向貸款人提交有關(guān)工程進(jìn)度、貸款用途、統(tǒng)計(jì)報(bào)表和資料。第七條因國(guó)家調(diào)整計(jì)劃、產(chǎn)品價(jià)格和修訂預(yù)算需要變更合同條款的,借款人和貸款人應(yīng)當(dāng)簽訂合同變更協(xié)議,第八條本合同經(jīng)雙方簽字蓋章后生效,有效期至年月日止。本合同一式三份,與貸款人簽訂,借款人和擔(dān)保人各執(zhí)一份,(p>
