2。通過存量房交易結(jié)算資金專用存款賬戶,買賣雙方簽訂的《存量房交易結(jié)算資金劃撥協(xié)議》見附件五。
(1)買受人以【直接支付給出賣人】【存入劃撥專戶】的方式支付定金。(二)買受人應(yīng)當(dāng)將房價(jià)存入雙方共同委托的房地產(chǎn)經(jīng)紀(jì)機(jī)構(gòu)或者備案的交易擔(dān)保機(jī)構(gòu)在北京的結(jié)算資金專戶(以下簡稱專戶)由銀行設(shè)立的存量房交易,除約定定金直接支付給出賣人外,賬號為。買受人取得房屋權(quán)屬證書后,出賣人應(yīng)當(dāng)持房屋權(quán)屬登記部門出具的《過戶登記表》到房地產(chǎn)經(jīng)紀(jì)機(jī)構(gòu)或者交易擔(dān)保機(jī)構(gòu)備案,并按照《資金過戶結(jié)算協(xié)議》辦理資金過戶手續(xù)股票交易。(3) 貸款協(xié)議書購房人申請按揭貸款時(shí),因自身原因未經(jīng)銀行或公積金管理中心批準(zhǔn)的,雙方同意按第條規(guī)定申請按揭貸款,解決辦法有三種:
(1)買受人提高剩余房價(jià),以現(xiàn)金方式支付給出賣人;
(2)買受人繼續(xù)申請其他銀行貸款,直至貸款獲批,并支付所發(fā)生的費(fèi)用辦理過程中的費(fèi)用由買受人承擔(dān);
(3)本合同終止后,買受人支付的定金和房價(jià)全部退還,雙方不承擔(dān)違約責(zé)任,辦理貸款過程中發(fā)生的一切費(fèi)用由買受人承擔(dān)。出賣人應(yīng)當(dāng)保證該房屋不存在產(chǎn)權(quán)糾紛。因出賣人原因致使房屋無法辦理產(chǎn)權(quán)登記或者發(fā)生債權(quán)債務(wù)糾紛的,由出賣人承擔(dān)相應(yīng)責(zé)任。
出賣人應(yīng)保證已如實(shí)說明該房屋的所有權(quán)、附屬設(shè)施設(shè)備、裝修及相關(guān)關(guān)系,附件一所列附屬設(shè)施設(shè)備及其對該房屋的裝修、裝修應(yīng)隨房屋一并轉(zhuǎn)讓給買受人,買受人應(yīng)當(dāng)充分了解出賣人出售房屋的具體情況,自愿購買房屋。
賣方應(yīng)保證自本合同簽訂之日起至房屋驗(yàn)收交接完畢,附件一所列房屋附屬設(shè)施設(shè)備及其裝修保持完好。
