第六條交付期限乙方應在收到該房屋全款之日起日內將該房屋產(chǎn)權證交付乙方,第七條乙方逾期付款的違約責任,自本合同約定的到期日第二日起至實際付款之日止,按月計息。
2。逾期不履行的,視為乙方未履行本合同。屆時,甲方有權要求乙方承擔違約責任。
(1)本合同終止時,乙方應按累計應支付金額的百分之十向甲方支付違約金,當甲方實際經(jīng)濟損失超過乙方支付的違約金時,實際經(jīng)濟損失與違約金的差額,由乙方賠償。
(2)乙方按%支付違約金,并繼續(xù)履行合同。第八條甲方逾期交付房屋的違約責任。除不可抗拒的自然災害等特殊情況外,甲方未在本合同第六條規(guī)定的期限內將該房屋交付乙方使用的,乙方有權按已付價款向甲方追償違約利息。自本合同規(guī)定的交貨期第二天起至實際交貨之日止,月利息為月內月利率計算,月利息按月利率計算。
2。逾期-如甲方不履行本合同,乙方有權按下列條款履行本合同,甲方應承擔違約責任。
(1)本合同終止時,甲方應向乙方支付乙方累計支付的違約金,乙方實際經(jīng)濟損失超過甲方支付的違約金時,實際經(jīng)濟損失與違約金的差額由甲方賠償/(2)甲方應按累計支付金額向乙方支付違約金,乙方應繼續(xù)支付履行本合同的違約金。
第九條產(chǎn)權登記協(xié)議
自乙方實際接管該房屋之日起,甲方應協(xié)助乙方在不動產(chǎn)產(chǎn)權登記機關規(guī)定的期限內向不動產(chǎn)產(chǎn)權登記機關辦理權屬登記手續(xù)。如因甲方原因導致乙方未能接管本合同,乙方在日內取得房地產(chǎn)權證的,乙方有權退房。甲方應自乙方要求退房之日起計算,乙方應在日內將乙方支付的款項退還乙方,并按%賠償乙方損失。第十條甲方保證交易時該房屋不存在產(chǎn)權糾紛,并在交易前完成抵押、抵押債務、稅金、租金等。交易完成后,甲方對上述事項承擔全部責任。第十一條房屋所有權轉讓產(chǎn)生的土地增值稅由甲方向國家繳納,契稅由乙方向國家繳納;其他房屋交易產(chǎn)生的稅費,除另有約定外,由甲、乙雙方按政府規(guī)定另行繳納。第十二條水費、電費、煤氣費、物業(yè)費、采暖費等費用的交接日期為年、月、日。第十三條甲方聲明和保證:甲方有權簽署并能夠履行本合同。
