該房地產(chǎn)項(xiàng)目的地價(jià)已經(jīng)支付,出售的房地產(chǎn)沒(méi)有抵押,沒(méi)有其他權(quán)利限制。經(jīng)深圳市土地和房地產(chǎn)主管部門(mén)批準(zhǔn)預(yù)售,房地產(chǎn)預(yù)售許可證號(hào)為。
第三標(biāo)的物情況樓房號(hào)(房號(hào)以附圖平面圖為準(zhǔn))為本合同標(biāo)的房地產(chǎn)(以下簡(jiǎn)稱(chēng)房地產(chǎn))。用于公寓/住宅/別墅/辦公/商務(wù)/工廠(chǎng)/建筑面積平方米,包括:建筑面積平方米、共用建筑面積平方米。

房地產(chǎn)項(xiàng)目土地使用權(quán)出讓合同及其補(bǔ)充協(xié)議約定的公用設(shè)施及配套項(xiàng)目見(jiàn)附件三。
房地產(chǎn)轉(zhuǎn)讓時(shí),轉(zhuǎn)讓人(出賣(mài)人)對(duì)同一土地上的道路、綠地、空地、閑置土地、電梯、樓梯、走廊、走廊、屋頂、外墻等共用部位的權(quán)益,應(yīng)當(dāng)同時(shí)轉(zhuǎn)讓。

(1)按公寓建筑面積:?jiǎn)蝺r(jià)為人民幣/港元/平方米,總價(jià)為人民幣/元,香港$ 1億××××100××100×××一萬(wàn)×10~(x)。集:總金額為人民幣/美元,香港元,1億美元,2萬(wàn)日元,一萬(wàn)萬(wàn)歐元。
(2)計(jì)算第五條代收代收是購(gòu)房款的代收代收機(jī)構(gòu)。
賣(mài)方在代收機(jī)構(gòu)的賬戶(hù)名稱(chēng)是什么,賬號(hào)是。第六條付款方式有三種:一、一次性付款;二、分期付款;三、抵押付款。
購(gòu)房者的首付為房地產(chǎn)總價(jià)的百分之十,其余部分支付給銀行貸款支付。具體付款方式和日期見(jiàn)附件二。第七條采用抵押的,出賣(mài)人應(yīng)當(dāng)書(shū)面通知買(mǎi)受人抵押的必要條件和應(yīng)提交的材料;出賣(mài)人應(yīng)當(dāng)自本合同簽訂之日起日內(nèi)協(xié)助買(mǎi)受人與銀行簽訂抵押貸款合同。如果買(mǎi)方無(wú)法獲得銀行按揭貸款,買(mǎi)方和賣(mài)方可以通過(guò)協(xié)商達(dá)成協(xié)議,選擇以下第二種方案,解決補(bǔ)充協(xié)議有三種方式:
(1)終止合同;
(2)改變付款方式。
出賣(mài)人選擇解除合同的,因出賣(mài)人過(guò)錯(cuò)致使買(mǎi)受人無(wú)法取得銀行按揭貸款的,出賣(mài)人應(yīng)當(dāng)返還買(mǎi)受人支付的全部房款和同期銀行貸款利息,并支付該房地產(chǎn)總價(jià)3%的違約金;因買(mǎi)受人過(guò)錯(cuò)不能取得銀行按揭貸款的,出賣(mài)人應(yīng)當(dāng)退還買(mǎi)受人支付的房款和扣除該房地產(chǎn)總價(jià)3%的違約金后的同期銀行貸款利息。第八條買(mǎi)受人逾期付款的違約責(zé)任有兩種處理方式:(1)按逾期時(shí)間處理。90天(含90天)內(nèi)逾期:自本合同約定的到期日起至到期日實(shí)際全額付款之日止,買(mǎi)方每天向賣(mài)方支付逾期金額0.03%的違約金,合同繼續(xù)履行;
2。逾期90天以上:賣(mài)方有權(quán)終止合同。如果賣(mài)方解除合同,買(mǎi)方應(yīng)按累計(jì)到期金額的10%向賣(mài)方支付違約金;如果買(mǎi)方愿意繼續(xù)履行合同,經(jīng)賣(mài)方同意,合同應(yīng)繼續(xù)履行,買(mǎi)方應(yīng)按0.04%向賣(mài)方支付違約金自合同約定的付款期限之日起至實(shí)際全額付款之日止,每日應(yīng)付的逾期金額。
本條所稱(chēng)逾期付款,是指本合同附件二規(guī)定的到期付款與實(shí)際付款之間的差額;分期付款的,按相應(yīng)分期付款與本期實(shí)際付款的差額確定。(二)。第九條買(mǎi)受人付清貨款后,出賣(mài)人應(yīng)當(dāng)向買(mǎi)受人出具付款憑證和購(gòu)貨發(fā)票。第十條房地產(chǎn)應(yīng)當(dāng)在日前交付買(mǎi)受人使用,并提供法律、法規(guī)規(guī)定的相應(yīng)工程竣工驗(yàn)收證書(shū)
